Our Covenants

covenant violations

  • A violation notice is sent by the covenant committee explaining the violation(s).
  • The homeowner has 30 days to correct the violation(s).
  • At the end of 30 days, a second letter is sent.
  • For each uncorrected violation, the homeowner is assessed a $50.00 fine.
  • At the end of 60 days and every 30 days thereafter, another letter is sent. For each uncorrected violation, the homeowner is assessed an additional and cumulative fine of $100.00.
  • If the homeowner corrects the violation but it occurs again within 90 days of the correction, the violation is considered to not have been corrected and the cumulative fine process resumes.

Virginia Rother-Simpson Park & Harold Rother Pavilion requirements

The Park and Pavilion are private, and for the use of association members and their guests. The following rules and requirements apply:

  • Hours are 9:00 a.m. - 9:00 p.m. unless extended hours are approved by the HOA board.
  • HOA members and guests are to use at their own risk.
  • Applicable HOA permission must be obtained prior to special events.
  • Pavilion reservations do not reserve playground equipment. 
  • Reserving members must be in good standing (dues paid, no covenant violations, etc.).
  • Homeowners are responsible for their guests. An adult HOA family member must be present.
  • HOA members will be fined for issues related to clean-up or repairs after reserved events.
  • Vandalism will be prosecuted.
  • Park visitors must be respectful of neighboring properties and not encroach on their land.
  • No alcoholic beverages are permitted.
  • No glass containers are permitted.
  • No gasoline-powered off-road vehicles (ATV, motorcycles, etc.).
  • Pets must be on leashes and cleaned-up after by their owners.
  • Fires must be confined to the pavilion grills only.
  • Patrons are required to leave the premises clean - trash disposed of and bathrooms neat.
  • Cleaning fees will be assessed as a fine if the pavilion is not clean after the reservation.
  • No erection of tents, inflatables, canopies, banners, etc. for a period longer than one day.
  • Overnight camping is prohibited.
  • Loudspeakers,  excessively loud music, or live music is prohibited.
  • No watercraft, swimming, or wading allowed in the pond. Toy watercrafts are permitted.
  • No activity is permitted that is expressly prohibited by city ordinance.
  • No golfing - lost balls present a hazard and liability to the mowing equipment if ejected.
  • Formal, repeated sporting events, or practices are prohibited.
  • No affixing of signs or banners with mechanical fasteners (nails, staples) to brickwork or wood trim.
